OFFICIAL RULES

During the Parade of Homes Rochester tour, entry forms will be available on the Parade of Homes Rochester website paradeofhomesrochester.org. 

NO PURCHASE OR DONATION NECESSARY TO ENTER TO WIN A PRIZE. A PURCHASE OR DONATION WILL NOT IMPROVE YOUR CHANCES OF BEING SELECTED AS A PRIZE WINNER.  ELIGIBILITY REQUIREMENTS INCLUDE QUALIFICATION AS A FIRST-TIME HOMEBUYER (NO OWNERSHIP OF HOME OR RESIDENTIAL PROPERTY IN PAST FIVE (5) YEARS), INCOME RESTRICTION LIMITATIONS, CLOSING ON THE PURCHASE OF A NEWLY BUILT OR EXISTING HOME WITHIN TWELVE (12) MONTHS AFTER PRIZE AWARD, AND AN ELIGBLE PROPERTY, AMONG OTHER REQUIREMENTS. ELIGIBILITY:  Open to legal residents of the United States, who are eighteen (18) years of age or older and of the age of majority in the entrant’s state of residence, and who reside in any of the fifty (50) states or D.C. at time of entry (“Entrant”). Employees, officers and directors of Housing First Minnesota (“Sponsor”), and others involved in the creation, production or execution of this sweepstakes, and their immediate family and/or household members are not eligible to enter.  Immediate family member is defined as husband, wife, children, mother, father, sister, sister in-law, brother, brother in-law or a child’s spouse. Void where prohibited by law. Additional eligibility requirements include, among others, no ownership of home or residential property within five (5) years, income limitations, and closing on purchase of an eligible single-family residential real property located in the State of Minnesota within twelve (12) months after prize award. TO ENTER:  This sweepstakes begins on or about 12:00 noon Central Standard Time (CST) on March 4, 2025, and ends at 6:00 p.m. CST on May 4, 2025 (the “Entry Period”). Administrator’s computer is the official time keeping device for this Entry Period.  Visitors to paradeofhomesrochester.org may enter the sweepstakes by fully completing the entry registration form (“Registration”) available during the Entry Period.  Entrants must complete the Registration accurately with all required information to receive one (1) entry for the prize drawings.  LIMIT one (1) Registration per individual. Once a Registration is submitted, an Entrant’s information cannot be changed.  Attempts made by the same individual to submit multiple Registrations and/or attempt to receive more entries than allowed in violation of these Official Rules by any method is prohibited and all entries made by such an individual will be disqualified.  All Registrations and entries shall be the property of the Sponsor and will not be returned.

 

CONDITIONS:  Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this sweepstakes in whole or in part at any time with or without notice.  Any notice of any cancellation, termination, modification or suspension may be posted on paradeofhomesrochester.org. Sponsor further reserves the right at its sole discretion to disqualify any Entrant it finds to be tampering or attempting to tamper with the entry process or the operation of the sweepstakes, violating the Official Rules, acting in an unsportsmanlike or disruptive matter, or with intent to annoy, abuse, threaten or harass any other person.  Any attempt by an individual to deliberately undermine the legitimate operation of the sweepstakes may be in violation of criminal and civil laws.  Sponsor reserves the right to seek damages and all other remedies from any such individual to the fullest extent permitted by law.  Any promotion materials that contain production, printing or typographical errors, or are obtained outside authorized or legitimate channels are void, and Sponsor’s liability, if any, is limited to the replacement of such materials.  This sweepstakes is governed by the laws of the State of Minnesota.

 

PRIZES/ODDS OF WINNING: Sponsor will award a total of one (1) down payment assistance grants to one Entrant at the end of the Entry Period. The down payment assistance grants will be provided for closing on a new home purchase or an existing home purchase. The chances of winning depend upon the number of valid entries.  All valid Entrants will receive one (1) chance to win. Each prize winner will be eligible to receive a $10,000 down payment assistance grant (a “Grant”) toward closing on the purchase of a qualifying home, approximate retail value of each Grant is $10,000. ALL WINNERS ARE SUBJECT TO VERIFICATION OF ELIGIBILITY.  Limit one (1) Grant per individual per household per closing.  At closing on purchase of a qualifying home, winner will be required to provide a valid social security number or tax identification number before the Grant will be awarded for tax reporting purposes. Winners cannot assign the Grant to any other party.  As a condition of accepting the Grant, each winner may be required to participate in reasonable press or other public relations activities as requested by Sponsor.   EACH WINNER MUST PAY ALL APPLICABLE TAXES, FEES, INSURANCE AND ANY OTHER EXPENSES NOT SPECIFICALLY LISTED HEREIN RELATED TO THE GRANT RECEIVED.

 

SELECTION OF WINNERS AND AWARDING OF GRANTS:  Each Grant winner will be selected by random drawing conducted on or about May 5, 2025, from among all eligible Registrations received during the Entry Period.  The drawing will be conducted by the Administrator, an independent judging organization whose decisions are final on all matters relating to this Sweepstakes. Approximate odds of winning are dependent upon the number of eligible Registrations received.  Each Grant winner must present to Sponsor personal identification bearing his or her photograph, name, age and address.  ALL WINNERS ARE SUBJECT TO VERIFICATION OF ELIGIBILITY.  Winners may not transfer, receive cash or make other substitutions for any Grant.  Sponsor may provide each winner an IRS Form 1099 for the full approximate value of the Grant as stated in these Official Rules, whether or not the winner actually uses the entire Grant.  Sponsor and its agents make no warranties, representations or guarantees relative to any Grant, and disclaim all liability for the provision, quality or nature of any third-party services provided to winners.  Each winner must sign any additional releases and/or waivers of liability required by Housing First Minnesota and/or any applicable sanctioning body, as appropriate, to receive the Grant.  All or any portion of a Grant not redeemed, accepted or used by winner will be forfeited.

 

CONDITIONS OF ENTRY:  All federal, state, and local laws and regulations apply.  Acceptance of any Grant constitutes permission to allow the Sponsor to use the winner’s name, voice, likeness and state of residence, and other biographical information for purposes of advertising and promotion without further compensation or right of review or approval, unless prohibited by law.  Sponsor reserves the right to substitute a Grant for another of equal or greater value.  By participating in the sweepstakes, each Entrant agrees fully and unconditionally (i) to be bound by the Official Rules and the decisions of the Sponsor or Administrator relating to participation and eligibility, selection of winners and awarding of Grants, whose decisions are final; (ii) TO RELEASE AND HOLD HARMLESS HOUSING FIRST MINNESOTA AND AFFILIATED COMPANIES, AND THEIR RESPECTIVE MEMBERS, SHAREHOLDERS, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS FROM INJURY, DEATH, LOSS OR OTHER LIABILITY THAT MAY ARISE FROM THE ACCEPTANCE OR USE OF ANY GRANT OR PARTICIPATION IN THIS PROMOTION; and (iii) to receive phone, e-mail and mail solicitation from the Parade of Homes® and their respective affiliates, even if otherwise listed on a do-not-call list or other similar list.  Any right to receive a Grant is contingent upon Entrant fulfilling all requirements and conditions of these Official Rules.

 

NOTIFICATION OF WINNERS: Potential winners will be notified by email and/or telephone using the information provided on the Registration form beginning on or about May 6, 2025.  Administrator will email notifications to potential winners who will be required to electronically sign a Declaration of Eligibility/Release of Liability/Publicity Release (“Required Paperwork”), which, among other things: (i) confirms compliance with these Official Rules; and (ii) confirms the release, representation and warranties and indemnification specified herein, and return the Required Paperwork to Sponsor no more than thirty (30) days after notification is sent by Administrator.  If Required Paperwork is returned as undeliverable or is not completed and returned less than thirty (30) days after notification is sent by Administrator, the Grant may be forfeited and an alternate potential winner may be selected, at the sole discretion of the Sponsor and Administrator.  Administrator will make up to (3) telephone attempts to each potential winner within the five (5) business day after the drawing.  If no one is available to accept the call a message will be left, but the call must be returned within 24 hours of the message.  Sponsor is not responsible for change in Entrant’s phone number or email address. Upon acceptance of the Grant, each winner will be required to accept the income tax liability for the total value of the Grant. Entrant’s failure to timely return the Required Paperwork may result in his/her forfeiture of the Grant. All potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.  All potential winners are subject to verification by Sponsor and/or Administrator, whose decisions are final and binding in all matters related to this sweepstakes.  An Entrant is not a winner of a Grant unless and until Entrant’s eligibility has been verified and Entrant has been notified that verification is complete and that they have been declared a winner by Administrator.  If any potential winner is found not to be eligible or not in compliance with these Official Rules, or if Grant notification or any Grant is returned as undeliverable, or winner does not respond to notification in the time set forth herein, or such winner does not otherwise accept the Grant as awarded, such potential winner may be disqualified in Sponsor’s sole discretion.

 

DISPUTES:  Except where prohibited, participants agree that any and all disputes, claims and causes of action arising out of or connected with this sweepstakes shall be resolved exclusively by arbitration pursuant to the Rules of the American Arbitration Association (“AAA Rules”) then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by participant with regard to this sweepstakes, but in no event attorneys’ fees, punitive, incidental, consequential or other damages.  THE AAA RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN MINNESOTA. EACH ENTRANT (OR PARENT/LEGAL GUARDIAN IF ENTRANT IS DEEMED A MINOR IN HIS/HER STATE OF RESIDENCE) AGREES THAT THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER (AND HERBY WAIVES THE ALL RIGHTS TO CLAIM) PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. EXCEPT WHERE PROHIBITED, YOU AGREE THAT ANY AND ALL DISPUTES, CLAIMS AND/OR CAUSES OF ACTION ARISING OUT OF, OR CONNECTED WITH, THE SWEEPSTAKES OR ANY GRANT AWARD SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION. Participants further agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or, in connection with the sweepstakes, the rights and obligations of participants and Sponsor and/or other entities involved in the creation, production or execution of this sweepstakes shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard for conflicts of law doctrine, and all proceedings shall take place in Hennepin County, Minnesota.

 

GENERAL RULES:  By participating in this sweepstakes, Entrant agrees (and agrees to confirm in writing if requested) to release, indemnify and hold harmless Sponsor, Administrator, and each of their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers, web masters, and their respective officers, directors, employees, representatives and agents (the “Released Parties”) from any and all liability for any: (i) act, failure to act, delay, or error relating to the transmitting or processing of entries or Registrations; (ii) lost, stolen, delayed, damaged or misdirected entries or Registrations or for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail to be sent or received between Sponsor and Entrant on account of technical problems, email rate limitations, or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an Entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the sweepstakes (iii) any incorrect or inaccurate information, whether caused by Entrant, printing errors or by any of the equipment, hardware, software or programming associated or used with the sweepstakes; (iv) any conditions caused by events beyond the control of the Released Parties that may cause the sweepstakes to be disrupted or corrupted; (v) any losses, liabilities, or damages of any kind resulting directly or indirectly from awarding, receipt, acceptance, use, or misuse of any Grant awarded to Entrant in the sweepstakes, including any item redeemed therewith or from Entrant’s participation in the sweepstakes; (vi) any printing or typographical errors in any materials relating to the sweepstakes; or (vii) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the sweepstakes or receipt or use or misuse of any Grant.  A Grant may not be transferred or substituted at any time, except at the Sponsor’s sole discretion. All federal, state and local taxes and any other fees or costs associated with acceptance of a Grant are the responsibility of each winner, as applicable.  Sponsor reserves the right, in its sole discretion, to disqualify any individual (and his/her Entry) determined to be in violation of these Official Rules or determined to have acted in an otherwise disruptive or dishonest manner or who tampers with the Entry process. Sponsor, Administrator and their agencies assume no responsibility for undeliverable emails resulting from any form of active or passive email filtering by a user’s internet service provider and/or email client or for insufficient space in user’s email account to receive email. Sponsor, Administrator and their agencies are not responsible for lost, late, incomplete, damaged, stolen or misdirected entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise or any incomplete or inaccurate information resulting from same. Proof of submission of Entry will not be deemed proof of receipt by Sponsor or Administrator. Sponsor’s or Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the sweepstakes if it is not capable of running as planned for any reason, including, but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other problems beyond the control of the Sponsor and may award each Grant from among all non-suspect eligible Entries received prior to cancellation, if any, in a manner it deems equitable and fair.
